Terms of Use (TOU) / Terms & Conditions

Effective Date: 12th December 2025

These Terms govern your use of www.dersegen.com ("Platform"), owned and operated by DerSegen (Proprietorship of Ms. Deepika Singhal).

Nature of Platform

DerSegen is a curated marketplace that facilitates:

Display of artworks
Promotion and marketing
Order collection
Customer communication
Dispatch from DerSegen to customer

DerSegen is not the creator, owner, or seller of the artworks.

Artist Responsibilities

Artists listing on DerSegen agree that:

Artworks are 100% original
All information provided is accurate
Materials and quality meet professional standards
They package and ship artworks to DerSegen's designated address
They comply with agreed timelines
They indemnify DerSegen for all customer claims

Customer Responsibilities

Customers agree that:

Minor colour/texture variations are normal
Artwork is handcrafted and may not be machine-perfect
Visual differences due to screens or photography are acceptable
They must inspect the artwork upon delivery

Pricing & Payment

Prices are determined collaboratively with Artists
DerSegen may revise listing prices
Payment is collected by DerSegen on behalf of Artists
Artist payouts follow the agreed payout model

Shipping Model

All artworks are shipped:

Artist → DerSegen Hub → Customer

DerSegen performs only:

Basic verification
Repackaging
Final dispatch

DerSegen is not liable for artwork condition prior to receiving it.

Returns & Refunds

Returns are allowed ONLY if:

Artwork is damaged during delivery to the customer
Artwork is significantly different from the description

(Not including minor colour/texture variations, framing differences, or artistic interpretation)

Not eligible for returns:

Change of mind
Minor deviations from images
Custom orders/commissions
Size perception differences

Intellectual Property

All artworks remain the exclusive IP of the Artist.
DerSegen receives a limited licence to display and promote artwork images.

Limitation of Liability

DerSegen is not liable for:

Artist behaviour, delays, misrepresentation
Artwork quality or originality
Damage before artwork reaches DerSegen
Incorrect descriptions by the Artist
Customer dissatisfaction with artistic style

Maximum liability is limited to the amount paid by the customer for that order.

Governing Law

These Terms are governed by Indian law; courts in New Delhi have exclusive jurisdiction.
